Most People Don't Take It Serious, Because It's Used More As A Means Of A Scare Tactic Then Anything Else.
Selling Rom's Is A Crime, Rom's Are Free, Much Like Emulators Are, Expecting To Pay Is The Same As Being Ask To Pay For The Air You Breath.
All Because Rom's Are Consider A Grey Area Matter In Terms Of Legal Wise, Doesn't Mean You Should Be Taken In By People That Expect You To Be Afraid Of Them, Or Charging You For Them, Etc.

Video Games Are Made, Typically For A Game System, & Handhelds.
Normally After A Game System/Handheld Goes Out Of Style "quits making them", Normally "sooner or later" They Quit Making Games For Game Systems, & Handhelds.
When They Quit Making The Video Games In Question For A Game System/Handheld Over A Set Amount Of Time They No Longer Make Money Off It.
Being That If They No Longer Make The Game For That Game System/Handheld They Can't Make/Lose Money For That Game They No Longer Sell.
However If A Game System/Handheld Video Games In Question Are Still Being Made & Game Companies Are Still Making Money From It, Using Rom's For Those Games Your Emulating Might Be Seen To Them As A Means That Could Cause Them To Lose Money.
Being In The End Like Music Such As MP3,s & Other Entertainment Stuff It's More About The Money Then About Copyrights Or Anything Else, But Copy Rights Falls More Into Place If Abuse Is Shown, Or If You Was Making A Game Based Off A Game That Was Made By A Game Company, Stuff Like That.
Through Games Like Say Zelda For Nintendo, Now It's Quite Obvious They Don't Make Nintendo Games Anymore, & That Using Nintendo Rom's Isn't Going To Cause Them To Go Around Suing People For Doing So Because There Not Losing Any Money From It.
Reason Why? Simple, Most Game Companies Are More Concern About Losing Money From Newer Rom's & Emulators For Newer Game Systems & Handhelds, Then On Older Game Systems/Handhelds Like Nintendo, Super Nintendo, Sega Genesis, Gameboy, "just to name a few".
Newer Being Like Playstation 2, Playstation 3, Nintendo Wii, Nintendo DS, Xbox 360, PSP Being Along Those Lines.

Rom's & Emulators, Are No Different Then Most Other Media Formats Out There Being Debated, But Rom's & Emulators Are In A Grey Area When It Comes Down To It.
However Most People Tend To Use Rom's & Emulators For Personal Uses, & Most Of The Time Are Used On Older Games & Game Systems/Handhelds That Are No Longer Around/Used /Sold, Etc" except on ebay".
In The End Once A Game Stops Being Made, & Hasn't Been Made For Awhile & The Game Company No Longer Sells It & Makes Money From It, Using It To Me Should Be Consider Legal.
After All Any Business Person Will Tell You That If Your Downloading Something That Isn't Worth Anything & Can’t Make Money Off It “or anymore money off of“, No One Is Going To Bother With It Not Even From A Legal Stand Point.
Another Thing Being That The Only People That Can Make Money Off Games That Isn’t No Longer Made Are People On Ebay, Flea Markets, & Used Game Stores, & Last Time I Check They Don't Own The Games They Sell Therefore They Can't Claim Any Rights To Them Regardless If There Nintendo Games Or Nintendo Wii Games.
Though In The End People Are Always Going To Use Rom's Regardless If There Legit Or Not, & Nothing I Say Will Change That.

This Faq Is Based Off My Own Opinions, Though At The Same Time Are Also Based On Things I Have Read & Saw & Talk To With Other People.
At The Same I'm Not Going To Say It's All Made Up Because It's Not, But For People Not To Misinterpreted As Something It Isn’t.
I Only Believe That Using Rom's & Emulators Are Fine To Use If It's Not Causing The Game Makers That Created Each Game From Losing Money & That People Aren’t Using Rom's As A Means To Make Money Themselves & Abusing Rom's In A Fashion That Would Make Them Wrong To Use Beyond The Use In Which They Were Made To Be Used For Being For Personal Use.
But As A Video Gamer I Know That From Reading Video Game Magazines & Other Such Things Helps Give You Better View Of Things.
